Fake testimonials are illegal if I am not mistaken and yes by them showing other people/your friends that you have used it even though you have not they maybe tempted to use it so in turn it is fake advertising.

By law there are several cases that I know of where lying is indeed illegal: * To a cop (or equivalent) on duty * To a customer through advertising (i.e. Hype) * To a clerk when you are getting married (i.e. are you currently single?) Other forms of lying are not controlled as far as I know. (i.e. cheating and lying about it will not get you to jail, just out of wedlock.) So... I would say that Facebook is in case (2) -- people through the FTC could go after their butt...
